This document sets out the Terms of Service under which NETCROHOSTING LLC,. offers its service in the **Republic of Singapore**. Every customer must accept these terms before contracting any of its products, which are subject to Singaporean law.

Important Note for Singapore Clients: All prices and fees are generally expressed in **US Dollars (USD)**, or their equivalent in Singapore Dollars (SGD) at the time of payment, unless otherwise specified on the invoice. These Terms and Conditions are governed by Singaporean legislation, including the common law and the **Personal Data Protection Act 2012 (PDPA)**.

This is a company dedicated to providing Domains, Web Hosting, Corporate Emails, VPS Hosting, Dedicated Servers, SSL Certificates, Colocation, and Reseller services; where its entire organization focuses on customer satisfaction, providing professional assistance tailored to the user's needs. All present and future services must adhere to the rules, terms, and conditions described in this document. The user accepts having read, understood, and agreeing without restriction to all the terms and conditions the company sets forth in the following document.

NETCROHOSTING LLC,. commits to complying with the following terms:

1. Communication, Notifications, and Payment Reminders

1.1. The Company will send its notifications, communications, and payment reminders via:

Messages through the ticketing system

Via email

1.2. It is the customer's responsibility to keep all their contact details updated in our system to properly receive Communications, Notifications, and Payment Reminders. The company also recommends using email addresses and contact numbers that are constantly checked.

1.3. The company is not responsible for any email that fails to reach its recipient and will assume all emails dispatched from our servers as delivered. If, for any reason, our server cannot deliver the message, the company will not be held responsible. It will be the customer's responsibility to be aware of the service expiration dates.

1.4. The customer understands and accepts that should they lose any registered or authorized contact details or decide to change them, the customer is obliged to communicate the change to NETCROHOSTING LLC,. with technical support within a maximum period of 72 hours so that communication between both parties is not interrupted and they do not lose administration of their services. The company provides a service system where the customer can check their payment dates and service expiration dates at any time on our website by logging into the client area with their registered and authorized email and password.

1.5. NETCROHOSTING LLC,. commits to providing **Technical Support** using the following tools:

Messages through the ticketing system

Via email

Via telephone

Other communication means linked to the Company.

Note: To provide support:

Via MSN only during office hours (08 a.m. - 6 p.m.)

Via ticket creation after 24 hours of purchase.

Via email after 24 hours.

Via telephone only during office hours (08 a.m. - 6 p.m.)

Game server plans do not include any type of support.

2. Customer Regulations

2.1. Unlawful Use of the Product

Our services may only be used for legal purposes. Any type of conduct or activity that may be deemed illegal under international laws and the applicable legislation in the **Republic of Singapore** (including, without limitation, the common law and acts related to consumer protection and data security) shall be prohibited, and the customer shall be solely responsible for any liability attributable to them, as well as the application of legal and contractual sanctions that may arise.

2.2. The above prohibitions include, among other activities:

Performing, promoting, or permitting the publication or transmission of any illegal, threatening, abusive, defamatory, obscene, offensive, pornographic, indecent, profane, or otherwise objectionable information or material, including without limitation any transmissions that constitute or encourage conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.

Restricting or inhibiting any other user from using and enjoying the Internet or services contracted by third parties with the company.

2.3. NETCROHOSTING LLC,. reserves the right to evaluate and qualify any situation or action that may be considered abuse, as well as to take the relevant decisions and sanctions, including the partial or definitive termination of the services contracted by the customer.

2.4. The Customer is responsible for:

The content hosted in the space provided by the hosting service/plan.

Errors caused by Internet Service Providers (ISPs).

Contamination by viruses or malware, and protection of their local equipment.

The internal configuration of their network, proxy, local firewall, office, access policies, security systems thereof, blocking, and unblocking of ports.

The correct use, assignment, and protection of administrative access data.

The vulnerability of the design of their website hosted on our services.

The security of the forms used on their website, programmed with the necessary security to prevent them from being used by third parties to send SPAM.

Monitoring the data transfer and space statistics of their Hosting and email accounts to take necessary actions if they consider their increase to be excessive.

Manually performing periodic backups of the account and downloading them locally during the service period.

The defective configuration by the customer of the Hosting service, domain, and email accounts.

2.5. Use of Server Resources

Users MAY NOT RUN the following on our servers:

Running any process(es) that require more than 8Mb of memory, more than 30 seconds of CPU, or use more than 5% of all available system resources at any time.

Running any type of real-time interactive chats that require server resources. Remote Hosting services are fully permitted.

Running any stand-alone, server-side process. This includes any and all daemons, such as IRCD.

Running any software that links to an IRC (Internet Relay Chat) network.

Also, as a user, you must accept that databases should only be used for NETCROHOSTING LLC,. web servers and no external access will be granted.

2.6. Serious Violations

The following points refer to activities that the company considers serious violations. Any indication of performing these activities will empower NETCROHOSTING LLC,. to proceed with the cancellation or suspension of the service without prior notice and without being obliged to refund any value paid by the customer.

Serious violations of the service by the customer include:

Sending unsolicited mail, Spam.

The use of servers for sending bulk mail is not allowed; only 150 emails per hour per hosting account are permitted for the normal use of a company or person, and not for sending advertising newsletters or informational bulletins.

Launching a denial(s) of service from our server(s) against any other server or any other type of equipment or system.

Seeking or successfully or unsuccessfully exploiting any server dependencies, seeking super-user access, all this including Exploits, Trojans, and similar.

Promoting, disseminating, or carrying out any type of action aimed at deteriorating the image of the company or any of its employees.

Accessing any kind of content that is outside the resources assigned to the customer by the company. For example, outside their root directory.

Maltreatment, threats of any kind, or any offense against any of NETCROHOSTING LLC,. employees will be sufficient reason for the immediate termination of services.

Using hosted websites, emails, and/or content to offer financial services such as loans, investments, currency exchange, money orders, credits, savings accounts, debit accounts, investment plans or funds, savings plans, collection, investment monitoring, insurance, stock and/or securities market, financial activities of employee funds, associative forms of the solidarity sector. To use our services for such financial purposes, the customer must acquire the service, attach the required documentation that supports the existence and surveillance of the territorial entities; which the customer must notify and send prior to the activation of the service. The customer understands and accepts that the provided supports and order information are subject to review, verification, and communication to the corresponding legal, control, and security regulatory entities.

Voluntarily or involuntarily causing damage to the servers that may affect the service of other customers hosted on the same server.

The Company reserves the right to require changes or to disable the website, account, email service, database, or any other component that does not comply with the policies indicated in this point without prior notice.

2.7. Bulk Emails and/or Unauthenticated Messages

NETCROHOSTING LLC,. has strict rules regarding the sending of bulk emails and/or unauthenticated messages, for the well-being of our customers and to prevent the server from being reported as a SPAM server. All bulk or unauthenticated email submissions are prohibited. This includes:

Sending newsletters (subscriptions, congratulations, etc.).

Sending bulk emails and/or mail merges.

Sending unsolicited emails.

Sending unexpected emails.

Sending emails that may be marked as spam.

Sending advertisements.

Sending messages to emails not directly obtained by the customer (e.g., purchase of databases, found lists, etc.).

Sending multiple messages to non-existent emails.

Including insecure or low-reputation external content in messages.

Accessing the email account from a low-reputation IP address.

Emails sent to lists with more than 30 recipients or with mail merge.

Performing scheduled notification sending that exceeds 50 sends in one hour (Transactional, automatic, bulk, normal mail, printers, scanners, incident reports, notifications, reminders, auto-registrations, etc.).

Sending more than 150 messages from one email account, or connecting to the account from more than 10 hosts, or sending more than 50 messages with the main account (web or scripts) in a 2-hour period.

Sending emails by means of scripts, forms, files, or binaries that do not contain captcha protection, automatic registration protection, and that do not have email account authentication information to perform the sending. (It is recommended to use libraries that allow authentication such as phpmailer or correctly configured CMS like Wordpress or Joomla, as the PHP mail function does not allow authentication).

Sending messages with the original sender modified.

Sending messages that do not comply with the domain's SPF verification; the customer understands that this record must be correctly configured in the domain and DNS servers.

3. Indemnification

The customer agrees to use NETCROHOSTING LLC,. services at their own risk. NETCROHOSTING LLC, is released from all liability for any loss of data or any other commercial damage, direct or resulting from unexpected incidents. The customer agrees to indemnify NETCROHOSTING LLC, in case of lawsuits or any legal activity against NETCROHOSTING LLC,, which may lead to expenses, losses, or any other type of outflows by the company, including the legal expenses incurred by the same. The customer agrees to defend, indemnify, and hold NETCROHOSTING LLC, harmless from the following liabilities:

Any damage caused to a person or property caused by a product sold or somehow distributed in connection with NETCROHOSTING LLC,. services.

Any material provided by customers that infringes or alleges infringement toward third parties.

Infringements of copyright or any regulatory regulation aimed at the protection of copyright, industrial property, intellectual property, among others.

The distribution of defective unauthorized products and/or provision of services sold and/or provided on behalf of NETCROHOSTING LLC,.

The company is exempt from any direct or indirect liability to third parties arising from conduct carried out by the customer for illegal purposes, both in their action and in their result.

The company will have full autonomy to investigate and determine whether the execution of any activity by the customer falls directly or by connectivity into any of the restrictions addressed in this point.

NETCROHOSTING LLC, will be the sole judge in determining whether these policies are violated.

4. Product Warranty

The customer understands that the product warranty is applicable only for the first 30 days of the first year of Hosting and Corporate Email plans. The refunded value corresponds only to the value of the Hosting and Corporate Email plan, but not the domain, nor any additional service acquired along with the Hosting or Corporate Email plan. The cost of amounts generated by the purchase transaction (Example: national bank commission) and refund are assumed by the customer. If the acquisition of the Hosting or Corporate Email plan includes any prize, bonus, included additional service, or the possibility of participating for a prize, they will lose them. Once the customer provides the complete information via email and confirmation of the same to make the refund, the refund is made within five (5) business days following.

5. Expiration, Suspension, Late Renewal, and Cancellation of Service

NETCROHOSTING LLC,. reserves the right to reject the initial service request or to deny the continuity of service provision as it deems appropriate. The company shall have the power to deny access to all or part of the service without prior notice if it is considered that the customer has engaged in conduct or activities that NETCROHOSTING LLC,. believes directly or indirectly violate any of the terms and conditions in this agreement. The customer authorizes the company to electronically supervise the services, as well as to disclose any information only when required by law or a competent authority. The company will proceed to remove or censor any kind of information or material that may be considered unacceptable, undesirable, or that results in the violation of any of the terms of this agreement.

5.1. Suspension

Causes for service suspension, in addition to those mentioned throughout this agreement, shall include the following:

Failure to proceed with the total payment of the contracted service values before the service expiration date.

Failure to verify the total payment of the contracted service values no later than two (2) days following the expiration of the installment or the service duration term or the invoice expiration and subject to the conditions established for each service selected by the customer; NETCROHOSTING LLC,. may decide whether to eliminate or cancel the service as of the third (3rd) day without leaving any copy of the information. The customer will have the possibility to request the backup of their website or files in their Hosting account only from the first to the third day after the hosting has expired. The customer understands that the delivered file has a necessary configuration and requirements that cannot be modified to be restored. In any case, it is known to the customer that the information contained in cancelled accounts will be permanently deleted by the company on the date of service cancellation.

Service suspension implies that the customer will not be able to use any NETCROHOSTING LLC,. service.

NETCROHOSTING LLC,. reserves the right to display a suspension page that will replace the customer's. This page may include, but is not limited to: advertising, any kind of information, and logos of NETCROHOSTING LLC,. and/or its providers.

5.2. Late Renewal

The customer understands that upon making the payment for late renewed services, the date applied for the renewal is the service expiration date and not the date the payment was made (regardless of the operation or non-possibility of access presented by the service). Except for only expired domains that become available again, they will be re-registered if possible with the date of the payment made.

Expired domains subsequently renewed and payments notified by the customer from the first day of expiration until the tenth day after their late expiration will take between 24 and 48 hours to reactivate due to the domain's required propagation of its DNS servers. The customer understands that during this propagation, their services may be unavailable, and this propagation time is not controlled by NETCROHOSTING LLC,., so the customer must wait for its completion.

5.3. Expiration

The customer releases NETCROHOSTING LLC,. from any liability or obligation regarding services whose validity has ended. NETCROHOSTING LLC,'s tolerance to keep a service active after its duration has ended, or the possibility of renewing a service after its validity has ended, is three (3) business days.

The customer has the possibility to notify the company about any complication that arises regarding the non-cancellation of the product or service, within a maximum period of ten (10) days prior to the expiration date of the product or service, understanding the following as complications:

Problems with transfers, bank deposits, or payments through other platforms.

It should be noted that this exception only applies to those customers who have a minimum seniority with the company of three (3) months and, likewise, it being understood by both parties that it will only be considered as an emergency measure for any unforeseen event that may arise for the customer, and not as a habitual payment conduct.

5.4. Cancellation Request

The customer has the power to cancel their product or service at any time they wish, by creating a cancellation request that includes a justification for this decision.

NETCROHOSTING LLC,. is released from the right to reimburse any value paid by the customer after they request a cancellation of their product.

6. Domains

6.1. Domain Registration

NETCROHOSTING LLC,. does not guarantee the availability of the domain until it is registered by NETCROHOSTING LLC,. and the customer is notified of the successful domain registration. If for any reason the customer has not received confirmation of the domain registration, they must notify the company by sending the payment receipt and must request written confirmation from NETCROHOSTING LLC,. personnel that the payment has been successfully received. If the domain is registered by another company or person before this period, NETCROHOSTING LLC,. will have no responsibility for this event. The customer undertakes not to enter any page other than the NETCROHOSTING LLC,. page to check its availability or for any other objective. The customer also undertakes not to disclose their domain name to any company or person before having received notification that the domain has been successfully registered. If the customer has not received notification of the registration of this domain after 72 hours of having made the payment, they must contact NETCROHOSTING LLC,. to notify their payment and request the domain registration. The customer understands and accepts that the domain may be registered with an international domain registration entity.

6.2. Domain Change

Once the domain is chosen, registered, and activated, it cannot be modified until the end of its contract period. Any typing error or change of mind about the requested domain is the customer's responsibility. If the customer decides to change the registered domain for a new one, the customer must register and purchase the new desired domain name that is available.

6.3. Domain Expiration

The domain expiration will take place on the same day of the period contracted by the customer. Therefore, if the customer does not want the services associated with the domain to be suspended, they must make the payment, report it, and have received confirmation from NETCROHOSTING LLC,. personnel before the expiration date. Our domain provider will change the domain's DNS servers if payment is not received by NETCROHOSTING LLC,. before the expiration date.

The customer accepts that expired domains cannot be transferred, modified, pointed, or released by NETCROHOSTING LLC,.

6.4. Domain Renewal after Expiration

NETCROHOSTING LLC,. gives the possibility to renew the domain up to 10 days after expiration by simply paying the domain renewal value, notifying the payment to the company, and requesting confirmation of payment receipt. If 10 days after the domain expiration the customer has not renewed the domain, then the domain will enter a state called **REDEMPTION**, this state will last 30 days. If the domain is in the **REDEMPTION** state and the customer wishes to renew it, they will have the option to do so by paying a late renewal fee called **REDEMPTION FEE**, currently this fee is valued at 80 US Dollars (.COM / .NET) and the value must be paid in any of the currencies on our website making the exchange using the TRM of the day of the transaction adding the value-added tax. After the 30 days of the **REDEMPTION** period, the customer will not be able to renew it until the domain becomes available. However, the customer understands that there is a possibility that the domain may be acquired by another company or person after the domain becomes free for registration, and NETCROHOSTING LLC,. will have no responsibility for this event. The customer acknowledges that it is their responsibility to maintain their own records and remember when their domain name registration expires. For their convenience, and not as a binding commitment, NETCROHOSTING LLC,. notifies the registered and authorized email about the need to renew their service.

6.5. Domain Transfer

The customer may transfer their domain to another provider as long as they are up to date with the services contracted with the company and the domain does not have an expiration date in the next 15 days, nor is it expired.

The customer authorizes NETCROHOSTING LLC,. to request the transfer of a domain from another provider when the order is placed from the NETCROHOSTING LLC,. website. The customer also undertakes to provide NETCROHOSTING LLC,. with a timely and truthful manner, all the necessary information for the domain transfer process, and the customer understands and accepts that the domain cannot have a different value according to the price indicated by the international domain entity.

NETCROHOSTING LLC,. is not responsible for the administration, changes, or renewals of domains whose transfer processes from other providers have not been successfully completed and confirmed by NETCROHOSTING LLC,. via email.

The customer accepts that the transfer of their domain name will be governed by this agreement and by ICANN's transfer policy, available at **transfer policy.**

6.6. Domain Release

The customer understands that NETCROHOSTING LLC,. cannot release or delete the registration of a domain once it is registered regardless of its status (current and active or expired). Cancellation or waiver by the customer of the domain service does not imply its release. After the domain expiration and non-renewal of the same after 40 to 120 days, it is possible that it will be automatically released by the international domain registration entity, making the domain available. However, the customer understands that there is a possibility that the domain may be acquired by another company, person, or processed by a domain registration entity after the domain becomes free for registration, and NETCROHOSTING LLC,. will have no responsibility for this event, and it is the customer's responsibility to verify when the domain becomes available again.

6.7 Domain WHOIS Information

The domain will be registered in the customer's name with the information provided in the purchase order. The domain's WHOIS registration information is public and mandatory according to the policies of ICANN (The Internet Corporation for Assigned Names and Numbers). The customer understands that the concealment or privacy of this registration requires the customer to acquire the additional Privacy Protect service which has an additional value not included in the domain registration value.

6.8. Operation Report

The customer will be solely responsible for monitoring their domain. If for any reason the domain presents any inconvenience, they must immediately contact the company and request confirmation of the report's receipt. In the event that a timely report is not made, the company will not be responsible for any inconvenience this may cause.

NETCROHOSTING LLC, commits to maintaining the stability of its servers through constant monitoring of its equipment.

7. No Warranty

NETCROHOSTING LLC,. provides no warranty that the service will be uninterrupted, error-free, or that any information, software, or material accessible on the service is free of viruses or other harmful components, as the customer accepts to know the technological implications generated in this regard and due to vulnerabilities of some systems to new developments, updates, or technological applications. Under no circumstances shall the company be directly, indirectly, specially, punitively, or consequentially liable for damages arising in any way from its use or inability to use the service, or for a third party, or for accessing the Internet or any part thereof, or its (or a third party's) inability to access a service or use information, service, or merchandise provided through the service, or resulting from error, omission, interruption, file deletion, error, defect, delay in operation or transmission, or any failure to function.

You understand that by putting information on NETCROHOSTING LLC,. servers, it will be available to all Internet users and that the company has no way of limiting or restricting access to such information or protecting such information against copyright infringement or any regulatory regulation aimed at the protection of copyright, industrial property, intellectual property, among others. Therefore, the customer assumes full responsibility and risk for its use on NETCROHOSTING LLC,. servers and the Internet.

Use of the service is at the sole risk of the customer. The company is not responsible for the files and data residing in your account. The customer agrees to take full responsibility for the transferred files and data and to maintain all appropriate reserves of the files and data stored on NETCROHOSTING LLC,. servers.

NETCROHOSTING LLC,. is not responsible for the loss of information that the customer places on NETCROHOSTING LLC,. servers.

NETCROHOSTING LLC,. does not guarantee and is not responsible for the delivery or receipt of emails. The customer understands that there is a possibility that emails may not arrive or be delivered to their recipient due to a technical problem either with NETCROHOSTING LLC,. or third-party servers. Nor is it responsible if emails are not received or delivered within a certain period of time. The customer understands that there is a possibility that emails may be held up and therefore take time to reach their recipient.

The customer accepts that saturation of the space or characteristics of the contracted service causes problems or unavailability of the service's operation.

The customer agrees not to interfere in any way with the operation of the system, including any attempt at unauthorized access.

8. Use of Registered Information

The customer accepts and acknowledges that NETCROHOSTING LLC,. will make the registration and service information available to ICANN, and/or third parties such as Verisign, Inc., Global Register Names Ltd., NeuStar, Inc., US Afilias, Inc., Global Domains International (collectively, "Registry Administrators"), and as applicable laws may permit or require. Furthermore, the customer acknowledges and accepts that ICANN and the Registry Administrators may establish guidelines, limits, and/or requirements related to the quantity and type of information that NETCROHOSTING LLC,. may or must make available to the public or private entities, and the manner in which such information is made available. Furthermore, you are not authorized to any and all access and use of such, and the guidelines, limits, and restrictions on the disclosure or use of the information provided by you in connection with the registration of a domain (including changes to such information), whether during or after the term of your domain registration. Moreover, the customer hereby irrevocably waives any claim and causes of action that may arise or have arisen from such communication or use of their registration information and Additional Information.

9. Governing Law and Jurisdiction (Exclusive for Singapore)

9.1. Governing Law. This Terms of Service agreement shall be interpreted and governed by the laws of the **Republic of Singapore**.

9.2. Jurisdiction. For the interpretation, compliance, and execution of this agreement, the parties agree to expressly submit to the exclusive jurisdiction of the competent **Courts of Singapore**, waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles or for any other cause.

The customer declares to have read and fully accepted these Terms of Service.

Final Note

If you do not agree with these terms, do not hire the services.
